Job Description Summary:
Fenwick & West is looking to expand its Chambers-ranked Privacy & Cybersecurity practice by adding an associate with two (2) to four (4) years of experience in health care privacy and other areas of privacy law. We’re looking for a privacy associate who can assist in advising clients as they develop products and services; draft and update privacy policies, procedures, training, notifications, forms of consent, and related documents; and provide other general privacy counseling.
This solicitation is for the firm’s Silicon Valley, Santa Monica, and Washington D.C. offices.

We provide our clients with comprehensive cybersecurity legal services, from governance, preparedness, and compliance to data breach response, and defense of regulatory investigations and multidistrict class-action litigation.
Our ideal candidate will have a solid understanding of:

Health information privacy (including human subjects research); Federal (HIPAA) and state (CMIA, Washington My Health My Data Act, Nevada SB 370) health care privacy laws;

Consumer privacy;

Other federal privacy laws, such as GLBA, FCRA, COPPA, and the FTC Act;

Comprehensive state privacy laws, such as the CCPA;

International privacy laws and regimes, such as the EU’s GDPR; and
-
General technology and data flows.
Candidates also should have:
- Experience drafting privacy policies, negotiating privacy-related contracts and data processing agreements (BAAs, DPAs, DUAs), providing product counseling, and conducting privacy compliance assessments;
- Experience investigating, remediating, and drafting notifications of for privacy and security incidents;
- Experience with adtech and cybersecurity (desirable but not essential);
- Superior academic credentials;
- Excellent oral, written, and interpersonal skills;
- Strong professional references; and
- California or District of Columbia bar membership (as appropriate) or eligibility to take the next available exam is required.
The anticipated range for this position is: $235,000 - $310,000. Depending on the role, the actual base salary offered may depend upon a variety of factors, including without limitation, the qualifications of the individual applicant for the position, years of relevant experience, level of education attained, certifications or other professional licenses held, and if applicable, the location in which the applicant lives and/or from which they will be performing the job. A discretionary bonus for eligible employees may also be available based on performance.
